ACCEPTANCE OF TERMS

By accessing and using TalkSpeechy ("Service"), operated by HYPERSMARTY LLC ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

2. DESCRIPTION OF SERVICE

TalkSpeechy is an AI speech generation platform. We are NOT a voice talent agency or recording studio. We use OpenAI and n8n workflows to generate synthetic speech from user-provided text prompts and deliver via email. Payments processed through Stripe.

3. SERVICE PROCESS

We maintain integration with OpenAI for speech generation and Stripe for payments. When you submit text prompts, we generate speech using AI and deliver via email. We may receive standard processing fees from our service providers.

4. USER RESPONSIBILITIES

You agree to:

  • Provide accurate text prompts
  • Be at least 18 years of age
  • Use the Service only for lawful purposes
  • Not input illegal, harmful, or abusive content
  • Not attempt to reverse engineer, scrape, or abuse the AI service

5. NO GUARANTEE OF QUALITY

We cannot guarantee perfect speech quality, voice accuracy, or delivery timing. Results depend on your input text, OpenAI model performance, and technical factors.

6. NOT PROFESSIONAL VOICE SERVICES

The Service provides AI-generated synthetic speech. We do not provide professional voice acting, commercial voiceovers, or guaranteed audio quality. You should test outputs and consult professionals for commercial use.

7. INFORMATION SHARING

By using our service, you authorize us to process your text prompts through OpenAI/n8n and share payment data with Stripe. Your information will be handled according to our Privacy Policy.

8. NO WARRANTIES

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. AI outputs may contain errors or imperfections.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, TalkSpeechy, a Division of HYPERSMARTY LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, including issues with AI-generated speech quality or delivery.

10. MODIFICATIONS TO SERVICE

We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability, including changes to AI providers or pricing.

11. CHANGES TO TERMS

We may revise these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

12. GOVERNING LAW

These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions.
