TalkSpeechy Affiliate Agreement

Last updated 29 August 2026. TalkSpeechy is a division of HYPERSMARTY LLC ("TalkSpeechy", "we", "us").

1. Enrollment

Enrollment is free and approved automatically when you create an account. We may decline, suspend, or remove any affiliate at any time, in particular for the conduct described in section 7. You must be 18 or older and provide accurate account and payout information.

2. Your referral link

You receive a unique referral code and link. When someone visits talkspeechy.com through your link, we store a first-party cookie identifying you as the referrer for 60 days (last click wins). If that person buys within the window and completes the questionnaire that carries your code through to checkout, the sale is attributed to you.

3. Commission

• You earn 20% of the amount the customer actually pays for a TalkSpeechy speech purchase — normally $7.80 on the $39 speech, or 20% of the discounted price when the referral discount applies.
• Commission is a one-time payment per qualifying sale. TalkSpeechy is not a subscription, so there is no recurring commission.
• A referred customer keeps earning commission for you on any additional speech purchases they make for 365 days from their first referred purchase.
• The $19 revision unlock and any other add-on that is not a new speech purchase do not earn commission.
• Self-referrals (buying through your own link) do not earn commission.

4. Customer discount

A customer referred by you receives 20% off their first speech, applied automatically at checkout. The discount applies once per customer.

5. Holding period and approval

Each commission is created as pending and clears to approved after a 45-day holding period, which covers our refund window. If the underlying purchase is refunded or charged back at any time before payout, the commission is voided.

6. Payouts

• Minimum payout is $50 in approved, unpaid commission.
• Payouts are sent monthly by PayPal or Venmo to the details on your dashboard. Keeping them current and correct is your responsibility.
• You are responsible for any taxes on amounts you receive. We may request tax information before paying.
• Unclaimed balances for accounts inactive for 12 months may be forfeited.

7. Promotion rules

You may not: bid on TalkSpeechy trademarks in paid search or use them in your domain; make false or misleading claims about TalkSpeechy or its output; use spam, unsolicited email, or deceptive redirects; offer unauthorized cash rebates on top of the customer discount; self-refer or coordinate circular referrals; or promote TalkSpeechy on sites containing illegal, hateful, or adult content. Coupon and deal sites require our written approval.

8. Relationship and IP

You are an independent contractor, not our employee, agent, or partner. You may use the TalkSpeechy name and logo only to promote us honestly, in an unmodified form, and you must stop on request. Nothing here grants you any other rights in our brand or content.

9. Changes and termination

We may change these terms, the commission rate, or the program itself at any time; material changes will be posted here with a new date. Either party may terminate at any time. Commissions already approved at termination are still paid at the next scheduled payout if above the minimum; pending commissions may be forfeited if you were terminated for a breach of section 7.

10. Disclaimer and liability

The program is provided "as is". To the maximum extent permitted by law, HYPERSMARTY LLC's total liability under this agreement is limited to the commissions payable to you in the 3 months before the claim.

11. Governing law

This agreement is governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules.
